Lemer and Company wins significant consumer class action certification decision in Seidel v, Telus. It is alleged that Telus charged their customers for ring and call set up time on incoming calls when their contracts required they charge only for “airtime” (talk time). The certification allows the action to proceed as a class – as opposed to an individual – action and is an important milestone in this action. This case has already been to the Supreme Court of Canada, which ruled the action should proceed despite a clause in the Telus agreement requiring that disputes be sent to arbitration.
